Information From Other Sources

We may receive information from dealership clients, business partners, event organizers, social media and advertising platforms, referrals, publicly available business sources, and vendors that support our website, scheduling, communications, and customer relationship management. We may combine this information with information we collect directly.

We may use personal information to:

  • Respond to inquiries, schedule and conduct consultations, and provide requested information.

Cookies, Analytics, and Advertising

The website and its service providers use cookies, pixels, local storage, and similar technologies for website operation, security, scheduling, chat, analytics, and advertising.

Technologies observed on the site include services associated with LeadConnector or GoHighLevel, Meta or Facebook, Cloudflare, Google-hosted resources, and content-delivery or font providers. These providers may receive device identifiers, IP address, browser information, and website activity as permitted by their configurations and applicable law.

Some advertising technologies may be considered “sharing,” “targeted advertising,” or a “sale” under certain state privacy laws even when no money changes hands.

Where required, you may exercise an opt-out through a “Your Privacy Choices” link or cookie-preference tool. You can also use browser controls to block or delete cookies, although some website functions may not work properly. Where applicable and technically feasible, we will process recognized opt-out preference signals, such as Global Privacy Control, as required by law.

How We Disclose Information

We may disclose personal information to the following categories of recipients for the purposes described in this Policy:

  • Service providers that support website hosting, forms, scheduling, customer relationship management, chat, email, telephone and text messaging, analytics, advertising, document storage, payment processing, accounting, security, and professional services.
  • Consultants, personnel, and business partners who need the information to respond to an inquiry or perform an engagement.
  • A dealership or organization you represent when necessary to coordinate or perform requested services.
  • Government authorities, courts, regulators, law enforcement, or other parties when required by law or reasonably necessary to protect rights, safety, property, or the integrity of our services.
  • A buyer, successor, lender, adviser, or other participant in an actual or proposed merger, acquisition, financing, reorganization, sale of assets, or similar business transaction, subject to appropriate safeguards.
  • Other recipients at your direction or with your consent.

We do not sell personal information or leads for money. We do not share mobile telephone opt-in information or SMS consent with third parties for their own marketing.

We may provide such information to vendors that help us deliver messages and administer our communications program, subject to contractual restrictions.

Dealership Client Information

In performing consulting and training, FOD may receive dealership operational records and information concerning dealership personnel or customers.

When FOD handles personal information for a dealership client, FOD will use it to perform the engagement, follow the applicable client agreement and instructions, apply reasonable safeguards, and not use it for unrelated marketing.

Requests concerning information controlled by a dealership may be directed to that dealership. Dealership clients are responsible for ensuring they have authority to provide information to FOD and for limiting disclosures to information reasonably necessary for the engagement.

Communications and Your Choices

Email

You may unsubscribe from promotional email by using the unsubscribe link in the message or contacting us. Even after opting out of marketing, you may receive non-promotional communications concerning an inquiry, appointment, contract, or ongoing business relationship.

Text Messages

If you consent to receive text messages, message frequency may vary and message and data rates may apply. Consent to promotional text messages is not a condition of purchase.

Reply STOP to opt out or HELP for help. We may send a confirmation of your opt-out. Opting out of promotional texts does not prevent us from responding through another channel or sending a text you specifically request, where permitted by law.

Telephone Calls

You may ask us not to make promotional calls to a telephone number. We will honor applicable do-not-call and consent-revocation requirements while retaining records necessary to document and administer your request.

Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including providing services, maintaining business and consent records, complying with legal and accounting obligations, resolving disputes, and enforcing agreements.

Retention periods vary based on the type of information, the relationship, contractual requirements, and legal obligations. We may delete, deidentify, or aggregate information when it is no longer needed.

Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a security incident affects information protected by law, we will provide notices and take other actions as required by applicable law.

Privacy Rights

Depending on your state of residence and whether a particular law applies to FOD, you may have rights to request access to or a copy of personal information, correction, deletion, information about categories of collection or disclosure, portability, restriction of certain processing, or an opt-out of targeted advertising, sale, or certain profiling.

You may also have a right to appeal a denial and to be free from unlawful discrimination for exercising a privacy right.

To submit a request, email [email protected] with the subject “Privacy Request” or write to the address below.

Describe your request and the state in which you reside. We may need to verify your identity and authority before responding.

These rights are not absolute. Applicable law may exempt certain business-to-business information, information processed solely for a client, or information that must be retained for legal, security, contractual, or other permitted purposes.

Children

The website and services are intended for business professionals and are not directed to children under 13.

We do not knowingly collect personal information from children under 13 through the website. If you believe a child has provided personal information, contact us so we can evaluate and address the request.

Third-Party Sites and Services

The website may link to or integrate with third-party websites, applications, social media platforms, and services, including Clubhouse. Their privacy practices are governed by their own notices.

We are not responsible for the privacy, security, or content of services we do not control.

We may update this Privacy Policy from time to time. We will post the revised version on the website and update the effective date.

If required by law, we will provide additional notice or obtain consent for material changes.
