These Terms of Service (“Terms”) govern your access to and use of fixedopsdoc.com and the website content, forms, scheduling tools, chat, and related online features provided by BAR Automotive LLC d/b/a The Fixed Ops Doc (“Fixed Ops Doc,” “FOD,” “we,” “us,” or “our”).

By accessing or using the website, you agree to these Terms. If you do not agree, do not use the website.

Website Purpose

The website provides information about automotive dealership fixed-operations consulting, coaching, training, and related services.

Website content is general informational and marketing material. It is not a substitute for a dealership-specific assessment and does not by itself create a consulting, fiduciary, employment, partnership, agency, franchise, or other professional relationship.

Eligibility and Business Use

You must be at least 18 years old and able to form a binding contract to use interactive website features.

If you use the website for a company or other organization, you represent that you have authority to act for that organization and that “you” includes that organization where appropriate.

Consultations and Client Engagements

Scheduling a consultation or submitting a form is a request to communicate; it does not obligate either party to enter an engagement.

The scope, fees, travel, scheduling, deliverables, confidentiality, data handling, cancellation terms, and other conditions of paid consulting or training will be governed by a separate proposal, statement of work, services agreement, order form, or other written agreement.

If that agreement conflicts with these Terms concerning the paid engagement, the signed agreement controls.

You agree to provide accurate scheduling and contact information and to notify us if you need to cancel or reschedule.

No Guarantee of Results

Dealership performance depends on many factors outside FOD’s control, including management decisions, staffing, market conditions, inventory, pricing, technology, implementation, and employee participation.

Examples, testimonials, historical achievements, projections, and descriptions of potential improvement are illustrative and do not promise that any dealership will achieve the same or any particular result.

Unless expressly stated in a signed agreement, FOD does not guarantee increases in revenue, gross profit, repair orders, labor hours, customer satisfaction, retention, efficiency, or any other metric.

No Legal, Tax, Accounting, or Regulatory Advice

FOD provides operational consulting and training, not legal, tax, accounting, employment, safety, manufacturer-compliance, warranty, consumer-protection, or regulatory advice.

You are responsible for obtaining qualified advice and for deciding whether and how to implement recommendations in compliance with applicable laws, manufacturer requirements, contracts, workplace rules, and dealership policies.

Intellectual Property

The website and its content, including text, graphics, photographs, videos, presentations, training methods, processes, downloads, logos, names, slogans, and other materials, are owned by or licensed to FOD and are protected by intellectual-property laws.

Fixed Ops Doc, The Fixed Ops Doc, WOW-CARound, associated logos, and related brand identifiers are trademarks or service marks of their respective owner to the extent protected by law.

Subject to these Terms, FOD grants you a limited, revocable, nonexclusive, nontransferable license to access the public website for lawful internal business evaluation.

You may not copy, reproduce, republish, upload, post, transmit, sell, sublicense, create derivative works from, scrape, train an artificial-intelligence system on, reverse engineer, or commercially exploit website or training content without prior written permission, except as allowed by law or a separate written agreement.

Acceptable Use

You may not:

• Use the website unlawfully, fraudulently, deceptively, or to infringe another person’s rights.
• Attempt to gain unauthorized access to the website, accounts, systems, forms, or data.
• Introduce malware, harmful code, excessive automated traffic, or technology intended to disrupt or circumvent access controls.

Public forms and chat are not appropriate for trade secrets, payment-card information, Social Security numbers, health information, or sensitive dealership customer or employee records.

By providing contact information, you authorize FOD to respond to your inquiry and send communications reasonably related to a requested consultation or service.

Promotional email, text, and telephone communications will be sent only as permitted by law and consistent with applicable consent and opt-out requirements.

The website may use or link to third-party platforms, applications, websites, scheduling tools, social media, and other services.

FOD does not control and is not responsible for third-party content, availability, security, products, terms, or privacy practices.

Website Availability and Changes

We may modify, suspend, or discontinue website content or features at any time.

We do not promise uninterrupted, error-free, or secure access, or that information will always be complete, current, or free of technical defects.

Disclaimer of Warranties

Limitation of Liability

To the maximum extent permitted by law, total liability arising from the public website or these Terms will not exceed one hundred U.S. dollars.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless FOD and its owners, officers, employees, consultants, and agents from third-party claims, liabilities, damages, judgments, losses, and reasonable costs arising from your unlawful misuse of the website, your violation of these Terms, or information you submit without necessary authority.

Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Before filing a lawsuit concerning the public website or these Terms, the parties will attempt in good faith for at least 30 days to resolve the dispute through written notice and informal discussion.

Unless a signed client agreement states otherwise or applicable law requires another forum, exclusive jurisdiction and venue will lie in the state or federal courts serving St. Johns County, Florida.

Copyright Concerns

If you believe content on the website infringes your copyright, send a notice to [email protected] identifying the copyrighted work, the allegedly infringing material and its location, your contact information, a good-faith statement that the use is unauthorized, a statement under penalty of perjury that the notice is accurate and you are authorized to act, and your physical or electronic signature.

Changes to These Terms

We may revise these Terms by posting an updated version and changing the effective date.

Changes apply prospectively when posted unless a later date is stated. Your continued use of the website after the revised Terms take effect constitutes acceptance.

General Terms

If any provision is held unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective.

These Terms and the Privacy Policy are the entire agreement concerning use of the public website, but they do not replace a signed client agreement.
